End User License Agreement

This EULA governs your use of the Stovyn application (mobile app, website dashboard) and the firmware running on the Stovyn device. By installing, accessing, or using any of these, you agree to this EULA and the separate Terms & Conditions. If you do not agree, do not install or use the Service.
1. Definitions
- --"Software" means the Stovyn mobile applications, website dashboard, web services, and the firmware embedded in the Stovyn device, including all updates and bundled documentation.
- --"Device" means a Stovyn hardware product purchased from us or an authorized retailer.
- --"Company," "we," "us," or "our" means Augeas Technologies Partnership Company.
- --"You" means the natural person or legal entity using the Software.
2. License Grant
Subject to your continuous compliance with this EULA and the Terms & Conditions, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- --install and use the mobile applications on devices you own or control, solely for your personal, non-commercial use, in connection with a Stovyn Device that you lawfully possess;
- --access the website dashboard with valid credentials;
- --operate the firmware as embedded in your Device, including over-the-air updates we deliver from time to time.
All rights not expressly granted are reserved by the Company and its licensors.
3. Restrictions
You will not, and will not permit any third party to:
- --copy, modify, adapt, translate, or create derivative works of the Software, except as expressly permitted by applicable law that cannot be waived by contract;
- --reverse engineer, decompile, disassemble, or attempt to derive source code or underlying ideas of the Software, except where the law expressly permits this for interoperability and you have first asked us in writing for the necessary information;
- --rent, lease, lend, sell, sublicense, distribute, or commercially host the Software (Software-as-a-Service or otherwise);
- --remove, obscure, or alter any copyright, trademark, or other proprietary notices in the Software;
- --flash, install, or run modified, unsigned, or unauthorized firmware on a Stovyn Device (this voids your warranty and may make the Device unsafe);
- --use the Software in any high-risk or life-critical application, including without limitation any medical, aviation, automotive, nuclear, or emergency-response system;
- --use the Software to develop a competing product or service, or for benchmarking or competitive analysis;
- --circumvent or attempt to circumvent any security, authentication, rate-limit, or content-protection mechanism;
- --use the Software in violation of any export-control law or sanctions program (including U.S. EAR, OFAC sanctions, EU dual-use export rules, and Indian SCOMET).
4. Intellectual Property
The Software is licensed, not sold. The Company and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights. No title to or ownership of any intellectual property is transferred to you by this EULA. Any feedback, suggestions, or ideas you submit may be used by the Company without restriction or compensation.
5. Software Updates
The Company may deliver updates, upgrades, patches, or new versions of the Software, including over-the-air firmware updates to the Device. Updates are subject to this EULA unless accompanied by a separate license, in which case the separate license controls. We may, in our reasonable discretion, require an update for the Software or Device to continue functioning, including for safety, security, or regulatory reasons.
6. Privacy & Data
Your use of the Software is also governed by our Privacy Policy. The Software performs detection and analysis on-device wherever feasible. Camera images on the Pro model are processed locally and are not streamed to our servers. We collect only the data described in the Privacy Policy.
7. Open-Source Components
The Software contains open-source components that are licensed under their respective open-source licenses (which prevail over this EULA for those components only, to the extent of any conflict). A list of components and their licenses is available at /attributions or upon written request to legal@augeastechnologies.com.
8. Disclaimer of Warranties
The Software is provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the maximum extent permitted by law. The Software is a diagnostic / informational tool; it is NOT a fire alarm, smoke alarm, CO alarm, gas detector, emergency response system, medical device, or safety system, and we DO NOT guarantee detection of unsafe conditions.
Some jurisdictions (including the United States, Canada, Mexico, and member states of the EU) do not allow the exclusion of certain implied warranties; in those jurisdictions the exclusions in this section apply only to the extent permitted by your local law, and your statutory rights remain unaffected.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will the Company, its affiliates, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business opportunity, arising out of or relating to the Software or this EULA, even if advised of the possibility of such damages.
The Company's total cumulative liability arising out of or relating to the Software or this EULA, from all causes of action and under all theories of liability, will not exceed the greater of (a) the amount you actually paid for the Device in the twelve (12) months preceding the event giving rise to liability, or (b) US $100.
Consumer-law carve-out: Nothing in this section excludes or limits liability that cannot be excluded or limited by your local mandatory consumer-protection law (such as the U.S. Magnuson-Moss Warranty Act, the Quebec Consumer Protection Act, the Mexican Federal Consumer Protection Law, or the Indian Consumer Protection Act, 2019). Where local consumer law conflicts with this section, that local law controls.
10. Termination
This EULA is effective until terminated. Your rights under this EULA terminate automatically and without notice if you fail to comply with any of its terms. Upon termination, you must stop using the Software, uninstall the mobile applications, and destroy any copies of the documentation in your possession.
The following sections survive termination: 3 (Restrictions), 4 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 11 (Export Controls), 12 (Governing Law), and any provision that by its nature is intended to survive.
11. Export Controls & Sanctions
You represent that you are not located in, and will not export or re-export the Software to, any country subject to comprehensive sanctions by the United States, the European Union, the United Kingdom, Canada, or India, and that you are not on any prohibited-party list maintained by those governments. You are responsible for compliance with all applicable export-control and sanctions laws.
12. Governing Law
The governing law of this EULA mirrors the region-specific governing law described in Section 14 of our Terms & Conditions. Where permitted by your local law, disputes arising under this EULA are subject to the same arbitration and class-action-waiver provisions as the Terms & Conditions.
13. App Store and Play Store Terms
If you obtained the mobile application from the Apple App Store, the Apple-specific terms in Schedule A (below) also apply. If you obtained it from Google Play, the Google Play Terms of Service apply alongside this EULA. In case of conflict between this EULA and the applicable app-store terms, the app-store terms control only as required by that store's distribution agreement.
Schedule A — Apple App Store Specific Terms
This EULA is between you and the Company only — Apple Inc. is not a party. The Company is solely responsible for the Software, its content, maintenance, and support. Apple has no obligation to provide any maintenance or support. To the extent the Software fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for product liability, regulatory compliance, or third-party intellectual-property claims relating to the Software. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you as a user.
