TERMS OF SERVICE + SAFETY DISCLAIMER

Provider: Augeas Technologies Private Limited ("Company," "we," "us")

Product: Stovyn hardware, mobile app, firmware, cloud services, and related features (collectively, "Service").

1. Acceptance & Clickwrap Agreement

By downloading, installing, accessing, or using the Service, or by tapping "I Agree," you enter into a binding agreement with us and confirm you have read, understood, and accepted these Terms. If you do not agree, do not use the Service.

2. IMPORTANT: NOT A SAFETY DEVICE / NOT EMERGENCY SERVICES

THE SERVICE IS A DIAGNOSTIC/INFORMATIONAL TOOL ONLY. It is not a fire alarm, smoke alarm, CO alarm, gas detector, emergency response system, monitoring service, medical device, or safety system. We do not guarantee detection of unsafe conditions.

WE DO NOT CONTACT EMERGENCY SERVICES. If you believe there is danger, call your local emergency number immediately.

3. No Guarantee; Errors and Environmental Limitations

The Service may generate false positives, false negatives, missed detections, incorrect classifications, or delayed alerts. Factors include (without limitation): stove type, cookware, steam/smoke, ambient temperature, reflections, obstructions, placement, airflow, background noise, microphone and sensor limitations, battery level, firmware/software issues, power interruptions, Wi-Fi/BLE connectivity, mobile OS restrictions, notification permissions, phone "Do Not Disturb," cloud outages, and third-party services.

You acknowledge that:

  • --Alerts are best-effort and may be late or not delivered.
  • --The Service is not a substitute for safe cooking practices and supervision.
  • --You remain solely responsible for kitchen safety, appliance maintenance, and compliance with all safety guidance and laws.

4. User Responsibilities & Safe Use Requirements

You agree to:

  • --Maintain functioning smoke/heat alarms and follow all manufacturer and local safety guidance.
  • --Use the Service only as supplemental information.
  • --Ensure device placement, power, battery charging, and permissions are configured correctly.
  • --Test the Service periodically and keep firmware/app updated.
  • --Not use the Service for any high-risk or life-critical purpose.

5. Informational Content; No Professional Advice

Any tips, warnings, or recommendations are general informational guidance. We do not provide professional safety, engineering, or emergency advice.

6. Data & Microphone / Audio Processing

If the Service uses a microphone or acoustic sensing: the Service may analyze sound on-device to extract limited signals (e.g., frequency peaks) for event detection. Unless expressly stated in the Privacy Policy, we do not store or upload raw audio.

Hardware may be technically capable of capturing audio, but the Service is designed to use audio as a sensor signal only. You are responsible for compliance with local consent laws.

7. Assumption of Risk

YOU ACKNOWLEDGE THAT COOKING, HEAT SOURCES, GAS FLAMES, ELECTRIC BURNERS, AND KITCHEN ENVIRONMENTS INVOLVE INHERENT RISKS INCLUDING FIRE, SMOKE, INJURY, PROPERTY DAMAGE, AND DEATH.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU VOLUNTARILY ASSUME ALL RISKS ARISING FROM OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID TO US FOR THE SERVICE/HARDWARE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR

(B) USD $100 (OR LOCAL CURRENCY EQUIVALENT).

Some jurisdictions do not allow certain limitations. In those jurisdictions, liability is limited to the maximum extent permitted by law.

10. Release & Waiver of Claims

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND FOREVER DISCHARGE THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, SUPPLIERS, AND AFFILIATES FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, AND DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING ANY FAILURE TO DETECT, ANY FALSE ALERT, OR ANY DELAYED OR MISSED NOTIFICATION.

This release does not apply where prohibited by law, and does not exclude liability that cannot be excluded (for example, certain statutory rights or willful misconduct where applicable).

11. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • (a)your use or misuse of the Service;
  • (b)violation of these Terms;
  • (c)violation of any law or third-party rights; or
  • (d)any claim by any third party relating to your kitchen, household, property, or cooking activities.

12. Binding Arbitration + Class Action Waiver

PLEASE READ CAREFULLY -- THIS AFFECTS YOUR RIGHTS.

Mandatory Arbitration

Except for small claims court matters (if applicable) and intellectual property disputes, any dispute or claim arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by an arbitration provider under its rules. Arbitration will be conducted on an individual basis.

Class Action Waiver

You and the Company agree that each may bring claims only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, or private attorney general proceeding. The arbitrator may not consolidate claims or preside over any class proceeding.

Opt-Out

You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@augeastechnologies.com with subject "Arbitration Opt-Out" and your account/device details.

13. Time Limit to Bring Claims

To the maximum extent permitted by law, any claim must be brought within one (1) year after the event giving rise to the claim, otherwise it is permanently barred.

14. Governing Law / Venue (by region)

The governing law and venue depend on your country of residence at the time you accept these Terms. Section 12 (Binding Arbitration + Class Action Waiver) applies wherever permitted by local law; some jurisdictions limit or prohibit consumer-arbitration clauses, in which case Section 12 does not apply to you and only the surviving provisions of this section govern.

If you reside in the United States

These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-law rules. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of Section 12. If arbitration is found unenforceable for a particular claim, that claim will be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to personal jurisdiction there. Nothing in these Terms limits your rights under any non-waivable consumer protection law of your state of residence (including, where applicable, the Magnuson-Moss Warranty Act).

If you reside in Canada

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, excluding conflict-of-law rules. Disputes will be resolved in the courts of Toronto, Ontario, except where you reside in Quebec, in which case the courts of the judicial district of your residence have jurisdiction and these Terms are also available in French upon request. Nothing in these Terms limits your non-waivable rights under provincial consumer protection legislation, including the Quebec Consumer Protection Act, the Ontario Consumer Protection Act, 2002, and equivalent statutes in other provinces, or your rights under the Personal Information Protection and Electronic Documents Act (PIPEDA), Quebec Law 25, or Canada's Anti-Spam Legislation (CASL).

If you reside in Mexico

These Terms are governed by the federal laws of the United Mexican States, excluding conflict-of-law rules. Disputes will be resolved in the competent courts of Mexico City. Nothing in these Terms limits your non-waivable rights under the Federal Consumer Protection Law (Ley Federal de Protección al Consumidor), the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP), or PROFECO oversight, including statutory return, refund, and warranty rights. Where mandatory Mexican consumer law conflicts with these Terms, the mandatory Mexican law controls.

If you reside in India

These Terms are governed by the laws of India, excluding conflict-of-law rules. The courts located in Hyderabad, Telangana, India have exclusive jurisdiction, except as required by the Consumer Protection Act, 2019 or the Digital Personal Data Protection Act, 2023, both of which are incorporated by reference where applicable.

If you reside elsewhere

We have not yet localized these Terms for your jurisdiction. By using the Service from outside the United States, Canada, Mexico, and India, you agree these Terms are governed by the laws of England and Wales, with disputes resolved in the courts of London — but always subject to any non-waivable consumer protection law of your country of residence. If your jurisdiction prohibits this choice of law for consumers, your local mandatory law applies instead.

15. Updates & Changes

We may update these Terms. Continued use after updates means you accept the revised Terms.
